Denison's June 2026 permit report lists a commercial remodeling permit for Rusty Chicken Saloon @ The Rialto at 424 W. Main St., and city agenda records describe the proposed use as a live-music venue inside the Rialto Theater. For Gainesville and Cooke County readers, the project shows how a nearby downtown entertainment venue is moving through building, historic-preservation and zoning review rather than opening on a permit record alone.
The Denison permit report lists permit 2026-1259 for the 424 W. Main St. property. The same entry names Rusty Chicken Saloon @ The Rialto and Tim Dighton.
The historic-building review is separate. Minutes included in the Denison Historic Preservation Board's July 21 agenda packet say the board approved a Certificate of Appropriateness for exterior work tied to the Rialto project. The approved work covered an ADA entrance railing, replacement doors, facade work and removal of refrigeration panels, according to the board record.
Planning and Zoning took up the venue use in a separate record. Draft minutes in the Aug. 11 Planning and Zoning Commission agenda packet say the commission recommended approval of a conditional-use permit for The Rusty Chicken at The Rialto as a live-music operation in the city use class covering dance halls and nightclubs. The recommendation covered versions with or without indoor alcohol sales.
That recommendation was not the last step described in Denison's own public guidance. The city's FAQ says Planning and Zoning forwards recommendations to City Council and that City Council has the final ruling on zoning cases. The records provided for this report do not show final City Council action on the Rusty Chicken request.
The Rialto's history is part of the city record around the project. A public archive record from The Portal to Texas History describes the Rialto Theater as built in 1922 as the flagship of H.W. Hall family's 22-theater chain. Denison historic-preservation staff, in a July 7 staff report for the 424 W. Main St. exterior request, described the Rialto as Denison's only historic theater and said it has stayed in entertainment use in some form.
Denison downtown officials had discussed Rusty Chicken before the Planning and Zoning recommendation. Minutes in the July 23 Main Street Advisory Board packet say board members discussed plans to coordinate post-concert activity with nearby downtown businesses as part of work on later business hours downtown.
The alcohol and dance-hall pieces sit inside local permitting systems. Gainesville's official alcohol-sales page says alcohol sales inside city limits require a city permit, a state-issued license or permit and the city fee. Sherman's zoning table lists commercial dance halls with a specific-use-permit designation in at least one zoning category. Those records are separate from Denison's case.
